General Terms and Conditions for the Provision of Services of the RehaGym Centre

These General Terms and Conditions for the Provision of Services of the RehaGym Centre (hereinafter also the "General Terms") contain basic information about the operation of the RehaGym multifunctional centre at V jehličí 2121/8, Prague 4 – Krč, and set out the basic rules that clients of the RehaGym centre are obliged to observe.

A) General Part of the General Terms

I.

  • Before using a service of the RehaGym centre for the first time, prospective clients are asked to complete an entry questionnaire in person at the reception of the RehaGym centre and to agree to these General Terms. By completing the entry questionnaire and agreeing to these General Terms, the prospective client concludes with RehaGym, s.r.o. a contract on the terms of use of the services of the RehaGym centre for an indefinite period and becomes a client of the RehaGym centre (hereinafter also the "client").
  • The client is entitled to use any of the services offered by the RehaGym centre, at their own choice.
  • The RehaGym centre places emphasis on an individual approach to every client and recommends that clients undergo at least one examination by a rehabilitation physician of the RehaGym centre in order to check the client's current state of health and to set up an optimal individual plan of RehaGym services for the client, so as to achieve the best possible results in improving the client's movement and health.
  • If the client no longer wishes to be a client of RehaGym, they shall notify the RehaGym centre by e-mail; in such a case the contract on the terms of use of the services of the RehaGym centre ends on the day following delivery of such notice. The contract on the terms of use of the services of the RehaGym centre also terminates automatically if the client does not use any service of the RehaGym centre for 12 consecutive months.

II.

  • Clients book the individual services of the RehaGym centre in advance, either in person at the reception of the RehaGym centre, by telephone on +420 790 421 111 or by e-mail to recepce@rehagym.cz. The RehaGym centre confirms the booked appointment to the client by sending a confirmation SMS or e-mail.
  • With the exception of group exercise classes (whose dates are fixed in advance), the client is entitled to cancel a booked appointment free of charge provided they do so at least 24 (twenty-four) hours in advance. Cancellation can be made by telephone on +420 790 421 111 or by e-mail to recepce@rehagym.cz. If the client does not cancel a confirmed appointment in time, RehaGym, s.r.o. may charge a cancellation fee of 100% of the price of the service booked (and not used) by the client.

III.

  • The RehaGym centre provides clients with services whose current overview is always set out in the price list available at rehagym.cz, at the prices stated in that price list. The prices stated in the price list are final for the client.
  • If a service is marked in the price list as a "group class" or a "programme", it can only be ordered as a whole. The price of such a service is the price for the entire group class course or the entire programme and is payable either as a single payment in advance or in monthly instalments, at the client's choice. Payment can be made in cash or by payment card (VISA, Mastercard) at the reception of the RehaGym centre, or by bank transfer to the bank details stated on the invoice issued by the RehaGym centre.
  • If a service is marked as a "group class", it can only be used on the dates fixed in advance for the individual parts of the specific course chosen, and these pre-set dates cannot be cancelled.
  • If the client, for whatever reason, does not attend part of a course, or does not use all the services within a programme during the period for which the programme of services is designed, they are not entitled to a refund of any part of the price of the course or programme.
  • If the client uses only an individual specific service (i.e. not a course or programme), they pay the price of the service used immediately after using it, at the reception of the RehaGym centre. Payment can be made in cash or by payment card (VISA, Mastercard).

IV.

  • In all areas of the RehaGym centre, clients are obliged to observe the smoking ban and to behave considerately towards other clients and the staff of the RehaGym centre. Clients are obliged to use the facilities and equipment of the RehaGym centre in accordance with their intended purpose and not to damage them.
  • If a client repeatedly or seriously breaches legal regulations or these General Terms in connection with the use of RehaGym services, the RehaGym centre reserves the right to terminate the contract on the terms of use of the services of the RehaGym centre with such a client, as of the day on which notice of termination is delivered to the client by e-mail.

V.

  • Clients of the RehaGym centre may address any questions, comments or complaints to the reception of the RehaGym centre, which will ensure that such submissions are passed on to the competent persons for handling.
  • Information on the processing of the personal data of clients of the RehaGym centre is available at rehagym.cz.
  • All relations between the client and RehaGym, s.r.o. are governed by the laws of the Czech Republic.
  • Within the meaning of Section 1752 of the Civil Code, RehaGym, s.r.o. is entitled to amend or supplement these General Terms and the price list of services of the RehaGym centre. Any such change will be notified to clients at least 30 days before its effective date by publishing the new wording at rehagym.cz and by sending an information e-mail to clients. The client is entitled to reject the new wording of the General Terms or the price list within 30 days of notification of the change, whereupon the contract on the terms of use of the services of the RehaGym centre terminates as of the day on which the change rejected by the client was to take effect.
  • The body for out-of-court settlement of disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, www.adr.coi.cz.
  • These General Terms and Conditions for the provision of services of the RehaGym centre are effective from 1 February 2025.

B) Rules of Operation of the RehaGym Fitness Facility

  1. RehaGym, s.r.o. is the operator of the fitness facility (gym and its amenities) located on the 1st floor (ground level) of the RehaGym multifunctional centre (hereinafter also the "fitness facility").
  2. The following are available to clients of the fitness facility:
    • lockable lockers in the reception area of the RehaGym centre, intended for storing clients' smaller valuables before entering the fitness facility (e.g. mobile phones, watches, car keys, payment cards, cash, etc.)
    • lockable lockers in the fitness facility changing room, intended for changing and storing belongings while the client exercises
    • showers and toilets.
  3. Only adult clients may use the fitness facility unaccompanied. Persons under the age of 18 may use the fitness facility only if accompanied by an adult supervising them, or if they exercise in the presence of a personal trainer of the RehaGym centre.
  4. No animals may be brought into the fitness facility (even on a lead or in a secure carrier).
  5. Entry to the fitness facility is permitted only in clean sports shoes or barefoot, and in suitable sportswear.
  6. No items may be brought into the fitness facility except non-alcoholic drinks in plastic containers, towels, mobile phones and headphones. Clients are obliged to leave all personal belongings other than valuables in the lockable lockers in the fitness facility changing room; valuables must be left in the lockable lockers in the RehaGym reception area.
  7. Clients are obliged to keep the fitness facility and its amenities clean and tidy. If a client discovers any defect in the fitness facility or its amenities (e.g. a non-functioning or damaged exercise machine or aid, a leaking shower, etc.), they shall report the defect to the reception of the RehaGym centre.
  8. Clients are not permitted to move racks, exercise machines or other equipment within the fitness facility, unless this is necessary or directly required as part of the equipment's normal use.
  9. Throughout the fitness facility and its amenities, the consumption of food, smoking, the use of open flames and the consumption of alcoholic beverages or other addictive or psychotropic substances are prohibited. Only non-alcoholic drinks in plastic containers, or isotonic or protein drinks purchased at the RehaGym reception, are permitted. Persons under the influence of alcohol or other intoxicating substances are strictly prohibited from entering the fitness facility.
  10. To maintain maximum hygiene in the fitness facility, clients are obliged to use a clean towel when using the exercise machines, either brought with them or obtained at the reception of the RehaGym centre.
  11. Clients suffering from any infectious disease transmissible by air, droplets or touch must not enter the fitness facility.
  12. Clients are obliged to behave considerately and in such a way that, while in the fitness facility, they do not disturb or inconvenience other persons present beyond a reasonable degree. Clients are obliged to use the fitness equipment only in accordance with the instructions for use (instructions are displayed in the fitness facility).
  13. If clients exercise in the fitness facility on their own, they may use only those exercise machines or other aids whose use corresponds to their current state of health and which they can operate safely in accordance with the instructions for use. Before using any exercise machine or other equipment, the client shall check that the equipment shows no defects preventing safe use.
  14. If the client exercises under the supervision of a personal trainer of the RehaGym centre, the personal trainer checks and sets up the exercise equipment. Given the limited capacity of the fitness facility, it is not possible to exercise in the fitness facility in the presence of a personal trainer other than a personal trainer of the RehaGym centre.
  15. In order to protect the privacy of RehaGym fitness clients, clients are prohibited from taking photographs or making any other visual, audio or audiovisual recordings in the fitness facility and all its amenities.

C) Rules of Operation of the RehaGym Car Park

  1. The building of the RehaGym centre includes a garage located on the 1st underground floor of the centre building, comprising a total of 9 parking spaces, 5 of which are for persons with reduced mobility (hereinafter also the "car park").
  2. Only clients of the RehaGym centre may use the car park, i.e. persons arriving at the RehaGym centre to use one of the services offered by the RehaGym centre, or persons using the co-working centre on the 3rd floor of the RehaGym centre (hereinafter together also the "users").
  3. Parking in the car park is subject to a charge according to the RehaGym price list of services.
  4. The car park's operating hours are from 7.00 a.m. to 5.00 p.m. every day. The car park may be used only during operating hours and only for the temporary parking of passenger motor vehicles.
  5. Entry to and exit from the car park are controlled by a barrier system operated from the reception of the RehaGym centre.
  6. When moving around the car park, users shall take care of their own safety. Users may remain in the car park only for the time strictly necessary to enter, park and unload, or to load and exit.
  7. All users of the car park are obliged to comply fully with Act No. 361/2000 Coll., on Road Traffic, within the car park. In particular, they must respect the vertical and horizontal signage in the car park and the instructions of the staff of the RehaGym centre (e.g. regarding the allocation of a specific parking space). The speed limit in the car park is 10 km/h.
  8. All users of the car park shall observe the safety and fire regulations applicable to the operation of the car park. The car park is not technically equipped for parking vehicles running on LPG, CNG or hydrogen. Such vehicles are therefore prohibited from entering the car park.
  9. When parking in a chosen parking space or one allocated by the reception of the RehaGym centre, the user is obliged to park so that the vehicle does not encroach on neighbouring parking spaces and does not hinder or prevent other vehicles from parking in those spaces.
  10. Vehicles parked in the car park must always be in proper technical condition for road use; in particular, no operating fluids may leak from them and no dirt (e.g. snow, mud, etc.) may fall from them beyond the usual extent.
  11. Every vehicle parked in the car park must be properly locked and secured against moving by itself.
  12. The following are strictly prohibited in the car park:
  • handling open flames,
  • carrying out any repairs or washing of parked vehicles,
  • replacing or topping up any operating fluids of parked vehicles,
  • interfering with the traffic signage in the car park or with the barrier system,
  • using trailers,
  1. leaving the engine running for more than 5 minutes while the vehicle is stationary.
  2. In the event of any technical problems or incidents concerning the car park (e.g. a malfunctioning barrier, damage to a parked vehicle, theft of items from a vehicle, etc.), the reception staff of the RehaGym centre must be contacted without delay and their instructions followed.
  3. In the event of a breach of the car park rules, the vehicle may be towed away at the user's expense.

D) Internal Rules of the RehaGym Healthcare Facility

  1. Pursuant to Section 41(1) of Act No. 372/2011 Coll., on Health Services, clients of the RehaGym centre who use the health services of the RehaGym centre (hereinafter also "patients") are obliged to comply with the internal rules of the healthcare facility.
  2. Compliance with the internal rules is very important for the cooperation between the patient and the attending physician or other healthcare professional.
  3. The patient is obliged to attend every scheduled therapy session/check-up. If they cannot attend, they are obliged to excuse their absence at least 24 hours in advance.
  4. Before providing health services, the attending physician or other healthcare professional informs the patient about their state of health, the proposed individual treatment procedure, the price, possible complications, the expected course and any alternatives to the treatment procedure. The patient always has the right to ask additional questions about their state of health and the proposed treatment procedure.
  5. All health services are provided only on the basis of the patient's consent (implied, oral or written) given after being informed by the attending physician or other healthcare professional.
  6. A signed refusal of treatment (informed refusal) is confirmation of the patient's disagreement with the proposed treatment procedure.
  7. The patient is always obliged to follow the individual treatment regime set by the attending physician or other healthcare professional; this plan may change over time depending on the patient's current state of health.
  8. The patient is obliged to pay the agreed amount for health services provided that are not covered by health insurance (RehaGym, s.r.o. has no contract with any health insurance company). If the health services provided are not paid for, the patient will be asked to pay.
  9. The patient is obliged to respect the type of facility, the level of expertise of the physician and the professional care provided in such a facility.
  10. RehaGym, s.r.o. may terminate the provision of health services to a patient who repeatedly (twice) fails to attend a booked treatment without excuse, seriously restricts the rights of other patients, intentionally and persistently fails to follow the proposed treatment procedure, declares disagreement with the provision of all health services, does not comply with the internal rules, or ceases to provide the cooperation necessary for the provision of health services.
